When should a business hire its first in-house lawyer?
There's no single trigger point, but the most common signal is when your external legal spend is growing faster than your revenue, and when the time taken to brief external counsel is starting to slow down commercial decisions. A good in-house lawyer typically costs significantly less annually than equivalent external legal fees, and they understand your business in a way that external counsel rarely does. If your leadership team is regularly waiting on legal sign-off before moving on commercial matters, it's worth having the conversation about whether an in-house appointment makes sense.
What is the difference between a General Counsel and a Legal Counsel?
A General Counsel (GC) leads the entire legal function of a business. They operate at a senior executive level, advising the board, managing legal risk strategically, overseeing external counsel relationships, and often sitting in or reporting directly to the leadership team. A Legal Counsel (or in-house counsel) is a practising lawyer embedded in the business whose focus is doing the legal work, contracts, commercial agreements, regulatory matters, employment issues. In smaller organisations one person often does both. As a business grows, separating these functions becomes important. We advise clients on the right structure before they go to market.
How long does it take to place an in-house legal professional?
For in-house legal roles, particularly at senior counsel or GC level, you should plan for a four to eight week process from brief to offer, depending on the seniority and complexity of the role and the speed of your internal decision-making. The strongest in-house legal talent are typically fielding multiple conversations simultaneously, so a prolonged process will cost you the person you want. Working with a specialist who already has relationships with the right talent significantly reduces time to shortlist.
How do I find a General Counsel in Australia?
Finding the right GC requires a search approach, not a job posting approach.
